Terms and Conditions Governing Enrollment in Shark Tank Season 3 Activity
I. ACTIVITY DESCRIPTION:
"Shark Tank India” (“Show”) is a reality series that provides entrepreneurs an opportunity to present their business ideas to a panel of investors or “sharks”, who decide whether to invest in their business. DBS BANK (“DBS”) have conducted enrolling activity for the Show where the interested individual, company, association of persons etc. (“You/Your/Yourself”) can enroll for the Show (“Activity”) starting form 31st August 2023 till 10th September 2023 (“Enrolling Period”) subject to fulfilment of the conditions as mentioned below and the terms and conditions as mandated on the SonyLiv.com by the Company (“Enrollment Steps”).
II. DEFINITIONS:
1. “Terms and Conditions”: These Terms and Conditions governing the Show, stated herein in entirety, as may be amended from time to time.
2. “DBS Website”: means www.dbs.com/India.
3. “Company”: means Culver Max Entertainment Private Limited (formerly known as Sony Pictures Networks India Private Limited)
4. “SonyLIV.com”: means the website owned and hosted by the Company where You can register for the Show.
III. PROCEDURE TO ENROL:
1. In order to enrol through the Activity, You have to fill in the details (including name, age, gender, email address etc.) request by the DBS Website during the Enrolling Period and once the details are successfully ingested in the DBS Website, You shall be directed to the registration page of SonyLIV.com where You will be able to access the registration process and upon successful completion of the terms and condition as mandated by Company on the SonyLiv.com registration page Your entry can be considered as a valid entry.
2. Once you have successfully submitted the details, no changes can be made to the same. Kindly ensure that you read the form and fill in the details carefully.
3. You should be an Indian citizen, residing in India, aged 18 years or above as of June 03, 2023, and of sound health and mind can enrol through the Activity. No person can enrol on behalf of another person. You will need to submit the requisite proofs of identity during the course of the audition. In case You are a minor, all the terms & conditions stated in the SonyLiv.com shall deem to apply on the parent/legal Guardian of the minor and the parent/ legal guardian of the minor shall enrol in the Activity on behalf of the minor at all times.
IV. GENERAL TERMS AND CONDITIONS
1. These Terms and Conditions may be subject to amendment from time to time and as such participation in the Show would be considered acceptance of the amended Terms and Conditions.
2. There is no levy of an entry fee for participation in the Show. Any person who claims to be from the Company/DBS Bank and asks the You for paying an entry fee for participation in the Show is defrauding You and he/she should report this to the local police immediately. There are also no lotteries, prize monies, cash prizes etc. distributed by the Company or the Show. The only to participate in the Show is in the manner detailed hereunder and any person who claims to be from the Company Terms and Conditions Governing Enrollment in Shark Tank Season 3 Activity | Page 2 of 3 and offers any lotteries, prize monies, cash prizes etc. to anyone is defrauding the person and he/she should report this to the local police immediately.
3. An enrollment is not transferrable.
4. You shall undertake, warrant and guarantee to the DBS Bank, that You has the full legal capacity to enroll in the Activity in accordance with these Terms and Conditions.
5. You represent that You has not been accused or convicted or is otherwise involved in any criminal offence (including but not limited to acts of moral turpitude and harassment) and/or is not under inquiry or trial by the police or judiciary.
6. You acknowledges that You has voluntarily chosen to enroll in the Activity at his / her free-will and is willing to bear all risk, costs & consequences arising from the same.
7. If You received any message from DBS Bank, it is assumed that the person sending it has provided the DBS Bank permission to send SMSs to You or call You, whether or not such sender is registered on the National Do Not Call registry.
8. You hereby consent DBS to contact You, through emailer, telecalling or other channels of communications for any promotional offers on products that DBS may be offering.
V. SUBMITTED MATERIALS
1. You will be required to furnish necessary details and/or supporting documents, such material will be considered as “Submitted Material” that is owned and controlled by You. You confirms that such Submitted Material is (i) being submitted voluntarily by You for further process in the Show (iv) You has the right/authority to submit and to offer such material without obligation to any third party, and the consent of no other person or entity is required.
2. You understands that the Submitted Material will be reviewed by the Company and any third-party agencies as may be hired by the Company with respect to the Show. For the purpose of the same, You hereby expressly consents to the Company reviewing the Submitted Materials and sharing the same with third-party agencies for the purpose of the Show.
VI. PERSONAL INFORMATION AND CONFIDENTIALITY
1. DBS Bank shall keep all the information collected from You confidential and shall use the same for the purpose of Show and for furtherance of any future business prospect with You. You hereby explicitly consents to the collection, storage and processing of such personal data and proprietary information collected from You. The term “Personal Data” shall mean and include the name and contact information (home address, telephone and fax numbers and email address), valid identity proof such as passport number, driver’s license number, permanent account numbers and marital status being collected for the purpose of the Activity.
2. DBS Bank shall deal with any Personal Data, that it receives You or otherwise collects, holds, uses and processes in the following manner: a) DBS Bank may disclose Personal Data, if any, to governmental agencies and regulators (e.g., tax authorities), social organizations (e.g., the social security administration), human resources benefits providers (e.g., health insurers), external advisors (e.g., lawyers, accountants, and auditors), courts and other tribunals, and government authorities, to the extent required or permitted by applicable legal obligations b) The level of data protection using technical, managerial, operational and physical security control measures by the Company shall be such as to be in compliance with all applicable laws. You further agree the Company is in no manner whatsoever shall be liable/responsible for the same and/or shall not be held liable in any manner whatsoever (including confidential of Personal Data and/or discloser of the same by DBS in any manner whatsoever).
3. You understand that sharing any information or Submitted Materials does not in any way obligate the Company to select You for the Show or for the Company to enter into any further agreement(s) with You, with respect to any matter arising out of or pertaining hereto.
VII. LIABILITY AND DISCLAIMERS
1. The Company is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any technical error on the DBS Website and/or for any reason whatsoever.Further, upon being directed to SonyLiv.com, DBS will in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any technical error on the SonyLiv.com website save and except for the reason attributable to DBS Bank and/or DBS Website.
2. The Company, evaluation panel, the host, the sharks, the advertising agencies, the sub-contractors used by Company for the Show, and any person or entity connected with the production (including the format owners of the Show), administration or judging of the auditions, the Show (the “Relevant Parties”) and DBS shall be under no liability whatsoever to You, in respect of any loss, damage suffered by You arising from the administration including any printing, typographical or technological errors in any materials associated with the enrolment process/Activity and/or in any manner whatsoever. Notwithstanding the generality of the foregoing, the Relevant Parties and DBS expressly exclude liability for all direct, indirect and consequential loss or damage, including but not limited to loss or damage to property or for loss of profit, opportunity, business, revenue, goodwill or anticipated savings pursuant to the Activity. In no event will the measure of damages include, nor will the Relevant Parties or DBS be liable for, any amounts for indirect, incidental, consequential, or punitive damages of any party, including third parties; or for damages attributable to You; or circumstances beyond the Relevant Parties or DBS including the Company’s reasonable control.
3. Without limiting the foregoing, DBS Bank specifically disclaim any warranty (a) that the DBS Website will be uninterrupted or error-free, (b) that defects will be corrected, (c) that there are no viruses or other harmful components that exist on the website (d) regarding the security of information submitted, and (e) regarding correctness, accuracy, or reliability. If You use of the DBS Website, SonyLIV App, Activity results in the need for servicing or replacement of Your or another's equipment or data, the Company and/or DBS Bank shall not be responsible for those costs.
4. You agrees that he/she shall indemnify, defend, settle and shall hold harmless the Company and DBS and any other person in connection with the Show, against any and all loss, claim, demands, costs, damages, judgments, expenses or liability (including legal costs) including third party claims of whatsoever nature at all time arising out of and in connection with including but not limited to (i) any claims of infringement of any third party rights (ii) any leak or disclosure of their idea/product/invention/service or business information (iii) any misrepresentation, misconduct, fraud by You informed/expressed by You (iv) any breach of law (v) any breach of the Terms and Conditions hereunder.
5. The Company shall not be responsible for negotiation, entry into or breach of any agreement not pertaining to the Show between the You and the DBS Bank (whether during or after the production of the Show and whether or not such negotiation culminates in a binding agreement) and You shall not raise any claim of any nature whatsoever against the Company and/or the sponsors of the Show.
6. The Company or DBS and their respective affiliates shall not be liable for any loss of earnings, employment or otherwise caused to You and arising as a result of You enrolment in the Activity.
7. The Company, DBS and its respective sub-contractors cannot and shall not be held accountable/liable for any disruptions / stoppages / interruptions or cancellation of the Activity.
8. If any provision of these Terms and Conditions is held by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these Terms and Conditions and the remainder of the affected provisions shall continue to be valid.
9. These Terms and Conditions shall be governed by and construed in accordance with the laws of India and irrevocably submit to the jurisdiction of the Courts in Mumbai.
10. Enrollment in the Activity does not guarantee Your selection or participation in the Show and such selection shall be as per the sole discretion of the Company or its affiliates.
11. The Terms and Conditions have been originally written in English and translated in Hindi. In case of any conflict in the interpretation of the clauses between the Hindi and English Terms and Conditions, the interpretation of the English Terms and Conditions shall prevail.
