Terms of Service for DBS Digital Platforms

These terms and conditions (“Terms and Conditions”) shall form a contract between the Cardmember and DBS Bank India Limited (“DBS Bank”) and shall be read in conjunction with the Cardmember Agreement and MITC as listed on the DBS Bank’s Website and other Terms and Conditions as may be applicable for the specific product/features availed by You/Cardmember.

  1. Definitions

    The following words and expressions shall have the corresponding meanings wherever appropriate:

    1. Account” shall mean a credit card account maintained with DBS Bank in the name of the Primary Cardmember.
    2. Application” shall mean DBS Bank’s Credit Card mobile application ‘DBS Card+ IN’ which can be downloaded onto the mobile phone of the Customer from Apple App Store (iOS) or Google Play Store (Android).
    3. Credit Card” shall mean the valid credit cards issued by the DBS Bank including Co-branded credit card.
    4. Customer” or “Cardmember” or “Primary Cardmember”, shall mean the individual in whose name the Credit Card has been issued and the Account is maintained by DBS Bank.
    5. Cardmember Agreement” means the agreement between DBS Bank and the Cardmember in relation to the Credit Card related services sent to the Cardmember along with the Credit Card welcome kit and also available on https://go.dbs.com/CCBenefits.
    6. DBS Bank’s Website” means www.Dbs.com/in.
    7. DBS Digital Platforms” means Application and Web Portal or any journey powered by DBS Bank initiated on third party/partner applications for co-branded credit cards issued by DBS Bank.
    8. EMI” means equated monthly instalments, which shall be governed by DBS Bank’s EMI Terms and Conditions. For more information kindly visit https://go.dbs.com/CCBenefits
    9. MITC” shall mean credit card’s Most Important Terms and Conditions applicable to each Credit Card, as sent to the Cardmember along with the Credit Card welcome kit and also available on https://go.dbs.com/CCBenefits.
    10. MPIN” shall mean the Personal Identification Number (password) for the Application.
    11. Registered Mobile Number” shall mean the Mobile number that has been used by the Customer to register for the Application.
    12. Virtual Credit Card” means a digital version of your DBS Credit Card available on the Application
    13. Web Portal” means DBS Bank website for Credit Cards.

  2. Applicability of Terms and Conditions

    By using the Digital Platforms, the Customers thereby agree and consent to these Terms and Conditions, which form the contract between the Customer and DBS Bank. Use of Digital Platforms shall be governed by such terms and conditions as amended by DBS Bank from time to time. DBS Bank may publish the amended terms and conditions on DBS Bank’s Website, which shall be construed to be sufficient notice to the Customer and use of Digital Platforms shall be deemed as acceptance of the amended terms and conditions. These Terms and Conditions shall be in addition to and not in derogation of other terms and conditions relating to any Account of the Customer and/or the respective product or the service provided by DBS Bank unless otherwise specifically stated. By registering /using the Application and/or using the Web Portal, you agree and consent to accept and bound by the “Terms and Conditions”.

  3. General Business Rules Governing use of Digital Platforms

    3.1 The access to Digital Platforms will be available to Customers holding an Account .

    3.2 Any change in the business rules of any of the processes will be notified on DBS Bank’s Website, which will be construed as sufficient notice to the Customer.

    3.3 DBS Bank reserves the right to reject a Customer’s request for the Application without assigning any reasons. The services offered under the Application will be automatically terminated if the primary account linked for the Application is closed. DBS Bank may also terminate or suspend the services without prior notice if the Customer has violated or DBS Bank believes that the Customer has violated these Terms and Conditions and/or any other terms and conditions laid down by DBS Bank or, on the death of the Customer when brought to the notice of DBS Bank.

  4. Services

    DBS Bank currently provides or may provide from time to time, Customer information and details of Customer’s Accounts and provides self-service features on Digital Platforms. Customers can view their Account summary, Account statements, bills, make payments towards their Credit Card outstanding, converting billed transactions to EMI, make payment to merchants via scan and pay features, manage Account, avail offers on Credit Card, reward points redemption, and use such any other features or services, as may be made available by DBS Bank from time to time, via Digital Platforms. DBS Bank may, at its sole discretion, add or remove the features and services available on Digital Platforms. The Customer agrees and understands that the services are provided on best effort basis and DBS Bank does not provide any guarantee or warranty, expressed or implied, including, but not limited to the warranties of merchantability, fitness for a particular purpose, satisfactory quality, accuracy, completeness, availability, non-infringement, security or reliability. The Customer expressly agrees that use of the Digital Platforms is at its sole risk. The Digital Platforms are provided on an "as is" and "as available" basis.

  5. Usage of Services on Digital Platforms

    By accepting the Terms and Conditions while registering for the Application, the Customer:

    5.1 Agrees to use the Digital Platforms for financial and non-financial transactions offered by DBS Bank from time to time.

    5.2 Also irrevocably authorizes DBS Bank to debit the Accounts which have been enabled for Digital Platforms for all transactions/services undertaken by using MPIN/Card PIN/OTP/Username/Password.

    5.3 Authorizes DBS Bank to map the Account number, Username, and Registered Mobile Number for the smooth operation of the Digital Platforms and to preserve the mapping record in its own server or server of any other third party and to use such data at its discretion for providing/enhancing further banking/ technology products that it may offer.

    5.4 Agrees that he/ she is aware and accepts that Digital Platforms offered by DBS Bank will enable him/her to transact using MPIN/Card PIN/OTP within the limit prescribed by DBS Bank and will be deemed as bonafide transaction.

    5.5 Agrees that the transactions originated using the Digital Platforms are non-retractable as these are instantaneous/real time.

    5.6 Agrees to use the Application on a mobile phone properly and validly registered in his/her name only with the Mobile Service Provider and undertakes to use the Application only through the registered Mobile Number.

    5.7 Agrees that while the Information Technology Act , 2000 (“Act”) prescribes that a subscriber may authenticate an electronic record by affixing his electronic signature which has been given legal recognition under the Act, DBS Bank is authenticating the Customer by using Registered Mobile Number, MPIN/Username/Password or any other method decided at the discretion of DBS Bank which may or may not be recognized under the Act for authentication of electronic records and this is acceptable and binding to the Customer and hence the Customer is solely responsible for maintenance of the secrecy and confidentiality of the MPIN/Password without any liability to DBS Bank.

    5.8 Authorizes DBS Bank to capture the location by using its internal services or any third-party services and to preserve the records in its own server or server of the third party and to use such data at its discretion for providing/enhancing further banking/ technology products that it may offer.

    5.9 Agrees and undertakes to provide accurate, complete and correct information as may be required by DBS Bank for the purpose providing services via Digital Platforms and shall be solely liable and responsible for accuracy and completeness of the information provided by him/her.

  6. Others

    6.1 The Customer shall be required to acquaint himself/herself with the process for using the Digital Platforms and that he/she shall be responsible for any error made while using the Digital Platforms.

    6.2 The instructions of the Customer shall be effected only after authentication under his/her Username and MPIN/password or through any other mode of verification as may be stipulated at the discretion of DBS Bank including but not limited to OTP based authentication, Biometrics Authentication (for the purpose of these Terms and Conditions Biometrics Authentication shall mean and include finger prints, and face recognition of the Customer)

    6.3 While it shall be the endeavour of DBS Bank to carry out the instructions received from the Customers promptly, it shall not be responsible for the delay/ failure in carrying out the instructions due to any reasons whatsoever, including but not limited to, system maintenance downtime (planned or unplanned), technology failure, failure of operational system, telecommunications or payment systems or due to any requirement of law. The Customer expressly authorizes DBS Bank to access his/her account information required for offering the services under the Digital Platforms and to share the information regarding his/ her accounts with the service provider/ third party as may be required to provide the services under the Digital Platforms.

    6.4 The transactional details will be recorded by DBS Bank and these records will be regarded as conclusive proof of the authenticity and accuracy of transactions.

    6.5 The Customer hereby authorizes DBS Bank or its agents to send promotional messages including the products of DBS Bank, greetings or any other messages DBS Bank may consider from time to time.

    6.6 The Customer understands that DBS Bank may send “rejection‟ or “cannot process‟ the request messages for the service request(s) sent by the Customer which could not be executed for any reason.

    6.7 The Customer expressly authorizes DBS Bank to carry out all requests/ transactions purporting to have been received via Digital Platforms and authenticated with his/ her MPIN/OTP/ Card PIN/Biometric authentication. In the case of payment facilities like mobile top up, bill payment, etc., the customer shall be deemed to have expressly authorised DBS Bank to make the payment when a request is received from him/ her.

    6.8 It is the responsibility of the Customer to advise DBS Bank of any change in his mobile number or loss/ theft of mobile phone by adopting the procedure laid down by DBS Bank for the purpose.

    6.9 The Telecom Service provider of the customer may levy charges for each SMS/ dial/GPRS, and DBS Bank is not liable for any dispute that may arise between such telecom service provider and the Customer.

    6.10 Customer may opt for One Time Password (OTP) auto read functionality available in the Application. Customer agrees to use this functionality at his / her own consent.

    6.11 The Customer agrees and understands that DBS Bank may from time to time incorporate such security measures and features on Digital Platforms as it may deem necessary and the Customer agrees to abide by such security measures implemented by DBS Bank, including but not limited to SIM binding. SIM binding is a technology allows only one user per device with a registered mobile number to execute transactions through the Application and the Customer may have to update the Application to access the new version of the Application with SIM binding – an enhanced security feature and may be required to complete one time registration process with the mobile device that has SIM of the registered mobile number. The Customer also understands that its access to Digital Platforms may be affected, limited or denied, unless the Customer agrees to use and access the updated versions of Digital Platforms as may be launched by DBS Bank.

    6.12 The Customer agrees and understands that the DBS Bank grants the Customer a limited right to access and use the Digital Platforms as per these Terms and Conditions.

    6.13 The Customer is discouraged to download, register and use the Application on a mobile device that is not owned by or in control of the Customer. The download and use of Application is also governed by the terms and conditions referenced in the application store (e.g., Apple App Store or Google Play store). Customer acknowledges that DBS Bank may, from time to time, issue upgraded versions of the Application, and may automatically electronically upgrade the version of the Application that the Customer is using on its mobile device. Customer hereby consent to such automatic upgrading of the Application on its mobile device, and agree that these Terms and Conditions will apply to all such upgrades. Where the upgraded version of the Application is not automatically installed, DBS Bank recommends the Customer to promptly install the upgraded version of the Application as DBS Bank may choose not to support the older versions of the Applications or any functionalities thereof which would affect the user experience of the Customer.

    6.14 The Customer is also advised to regularly update its operating systems and antivirus software to ensure secure access and usage of Digital Platforms.

    6.15 The Customer agrees and understands that the Digital Platforms including the contents and information therein, DBS Bank’s trademarks, service marks, logos are DBS Bank’s intellectual property, and the Customer is prohibited to use or otherwise copy, reproduce, transfer, distribute DBS Bank’s intellectual property or infringe DBS Bank’s intellectual property rights. The Customer shall not (nor permit any other person) modify, disassemble, decompile, reverse engineer or otherwise attempt to discover the source code, underlying ideas, underlying user interface techniques or algorithms of the Application or remove, circumvent, disable, damage or otherwise interfere with security related features of the Application or delete the copyright or other proprietary rights notices on the Application.

    6.16 As part of offers extended to the Customers and purely for your convenience, DBS Bank provide ‘third party links’ on the Digital Platforms. If you use these ‘third party links’, you will leave DBS Bank’s Digital Platforms and will be redirected to third party website/platform. Use of such ‘third party links’ is solely at your own discretion and risk. The ‘third party links’ are websites and platforms operated by third parties and DBS Bank does not sponsor or endorses such third party websites/platforms or the content thereof and DBS Bank will not be liable for the products or services offered by such third parties.

  7. Fee structure for the Application

    DBS Bank reserves the right to charge the Customer a fee for the use of the services provided under the Digital Platforms and change the fee structure at its discretion. Display of such charges on DBS Bank’s Websites would serve as sufficient notice and the same is binding on the customer.

  8. Accuracy of Information:

    8.1 It is the responsibility of the Customer to provide correct information to DBS Bank using the Digital Platforms. In case of any discrepancy in this information, the Customer understands that DBS Bank will not be in any way responsible for action taken based on the information. DBS Bank will endeavour to correct the error promptly wherever possible on a best effort basis, if the customer reports such error in information.

    8.2 The Customer agrees and understands that DBS Bank will try, to the best of its ability and effort, to provide accurate information, however DBS Bank shall not liable for any inadvertent errors or omissions in the information provided to the Customer.

    8.3 The Customer accepts that DBS Bank shall not be responsible for any errors which may occur despite the steps taken by DBS Bank to ensure the accuracy of the information and shall not have any claim against DBS Bank in an event of any loss/ damage suffered as a consequence of an information provided by DBS Bank found to be not correct.

  9. Responsibilities and obligations of the Customer

    9.1 The Customer will be responsible for all transactions, including unauthorised /erroneous/ wrong/ incorrect/mistaken/false transactions made through the use Digital Platforms including, but limited to, via use of his/ her mobile phone, SIM card and MPIN, regardless of whether such transactions are in fact entered into or authorized by him/ her. The Customer will be solely liable and responsible for the loss/damage, if any suffered in respect of all such transactions.

    9.2 The Customer shall take all possible steps to ensure that the Application and his/her mobile phone are not shared with anyone and shall take immediate action to block the SIM card and/or block the Credit Card in case of misuse/ theft/loss of the mobile phone or SIM card.

    9.3 The Customer will use the services offered under the Digital Platforms using the MPIN/Password in accordance with the procedure as laid down by DBS Bank from time to time, including the terms and conditions contained herein.

    9.4 The Customer shall keep the Username and MPIN/ password / OTP confidential and will not disclose these to any other person or will not record them in a way that would compromise the confidentiality of the same or the security of the service.

    9.5 It will be the responsibility of the Customer to notify DBS Bank immediately if he/ she suspect the misuse of the MPIN/Password or any unauthorised activity on Customer’s Account/Credit Card. Customer should also immediately initiate the necessary steps to change his/her MPIN.

    9.6 The Customer accepts that any valid transaction originating from the Username and / or registered mobile phone number shall be assumed to have been initiated by the Customer and any transaction authorized by the MPIN/Card PIN is duly and legally authorized by the Customer.

    9.7 The Customer shall keep himself/herself updated with regard to any information/ modification relating to the services offered under the Digital Platforms which would be publicized on the DBS Bank Website and/or at DBS Bank branches and would be responsible for taking note of / compliance of such information/ modifications in making use of the Digital Platforms.

    9.8 The Customer shall be liable for all loss or breach of the Terms and Conditions contained herein or contributed or caused the loss by negligent actions or a failure to advise DBS Bank within a reasonable time about any unauthorised access in the Account.

    9.9 The Customer shall be liable and responsible for all legal compliance and adherence of all commercial terms and conditions in respect of the mobile connection/SIM card/mobile phone through which the facility is availed and DBS Bank does not accept/ acknowledge any responsibility in this regard.

  10. Disclaimer

    10.1 DBS Bank, when acting in good faith, shall be absolved of any liability in case: DBS Bank is unable to receive or execute any of the requests from the Customer or there is loss of information during processing or transmission or any unauthorized access by any other person or breach of confidentiality or due to reasons beyond the control of DBS Bank. DBS Bank shall not be liable for any kind of losses or damages, direct or indirect, incurred by the Customer or any other person due to any failure or lapse in the Application, which are beyond the control of DBS Bank including but not limited to any failure or delay in transmitting of information or there is any error or inaccuracy of information or any other consequence arising from any cause beyond the control of DBS Bank which may include technology failure, mechanical breakdown, power disruption, etc. There is any lapse or failure on the part of the service providers or any third party affecting the said transaction on the Application and that DBS Bank makes no warranty as to the quality of the service provided by any such provider.

    10.2 Customer agrees and understands that DBS Bank shall endeavour to provide the products and services under the Application on best effort basis and DBS Bank or its service providers/third party providers shall not be liable for non-availability of the products or services or arising out of use of the services or any error, delay or failure to act on any instruction of the Customer, including any loss or damage incurred or suffered by the Customer. DBS Bank, its employees, agent or contractors, shall not be liable for and in respect of any loss or damage whether direct, indirect, incidental, exemplary, punitive, special or consequential, including but not limited to loss of revenue, profit, business, contracts, anticipated savings or goodwill, loss of data, loss of use or value of any equipment including software, whether foreseeable or not, suffered by the Customer or any person howsoever arising from or relating to any delay, interruption, suspension, resolution or error of DBS Bank in receiving and processing the request and in formulating and returning responses or any failure, delay, interruption, suspension, restriction, or error in transmission of any information or message to and from the telecommunication equipment of the Customer and the network of any service provider and DBS Bank's system or any breakdown, interruption, suspension or failure of the telecommunication equipment of the Customer, DBS Bank's system or the network of any service provider and/or any third party who provides such services as is necessary to provide the Application.

    10.3 DBS Bank will not be responsible if the Application is not compatible with/ does not work on the mobile device or operating system of the mobile device of the Customer.

  11. Indemnity

    In consideration of the Bank providing the services on the Application, the Customer agrees to indemnify, protect and hold DBS Bank including its directors, employees, agents, representatives, contractors and affiliates harmless against all actions, claims, demands, proceedings, losses, damages, costs, charges, and expenses which DBS Bank may at any time incur, sustain, suffer, or be put to arising out of any services provided to the Customer pursuant hereto. The Customer shall indemnify DBS Bank for unauthorized access by any third party to any information/instructions/triggers given by the Customer or breach of confidentiality.

  12. Disclosure of Information

    Customer hereby irrevocably agrees to and consents that the Bank may disclose at any time and share with or in any manner make available to any agencies, bureaus, affiliate companies, firms, associations, corporate bodies and other persons including any outside agencies any information of the Customer as may be required in strict confidence. Customer further agrees that the Bank may hold and process his personal information on computer or otherwise in connection with any service for statistical analysis and credit scoring. The Customer also agrees that the Bank may disclose in strict confidence to other institutions such personal information as may be necessary for reasons inclusive but not limited to, participation in any telecommunication or electronic clearing network, and/ or as necessary for compliance with any legal or regulatory directive/instruction e.g., for credit rating by a credit rating agency or for fraud prevention purposes etc.

    Customer further agrees and consents that DBS is availing the services from Bank’s affiliates or third-party service providers and consents to disclosing any personal information to such service providers who have a legitimate business purpose for obtaining such information, including but not limited to offering you products or services in connection with or to facilitate the use of Card, risk management purposes and as part of card related technology services.

  13. Governing Law & Jurisdictions

    The Terms and Conditions are governed by the applicable laws in India, without reference to its conflict of laws provisions. Any dispute or claim pertain to the Terms and Conditions herein are subject to the exclusive jurisdictions of competent courts/tribunals/forums in Mumbai and the Customer agrees to such exclusive jurisdictions in Mumbai.

  14. Terms and Conditions for the use of the DBS Biometrics/Face ID sensor login service (“Facility”)

    14.1 By opting in for the Facility, where in you may use your biometrics/face id registered on a permitted mobile device in lieu of your DBS MPIN/Password as a security code to confirm your identity to access the Application.

    14.2 You acknowledge and agree that in order to use the Facility:

    1. You must be a valid user and Cardmember.
    2. You must install our mobile app using a permitted mobile device.
    3. You will need to activate the biometrics recognition, face id recognition function on your permitted mobile device and register at least one of your biometrics to control access to the permitted mobile device.
    4. The biometrics stored on your permitted mobile device will be a security code.
    5. You must ensure that only your biometrics are stored on your permitted mobile device to access the device and you understand that any biometrics that is stored on your permitted mobile device can be used to access the Application including access to your accounts; and
    6. You should ensure the security of the security codes as well as the password or code that you can use to register your biometrics on the permitted mobile device.

    14.3 You may still choose to access the mobile app using your Password/MPIN.

    14.4 Each time the Application detects the use of a biometrics registered on a permitted mobile device on which you have registered for the Facility to access the Application or authorize transactions, you are deemed to have accessed the Application or mobile banking services and/or instructed us to perform such transactions, as the case may be.

    14.5 You acknowledge that the authentication is performed by the Application by interfacing with the fingerprint authentication module on the permitted mobile device and that you agree to the authentication process.

    14.6 You can deactivate the biometrics login/ face id recognition service at any time using the Slide button available in “Finger Print Access” under “More” on the right bottom post logging in.

    14.7 If you inform us that the security of your fingerprints/face id recognition or other security code has been compromised, we may require you to change the security code, re-register your fingerprints or cease the use of the Facility.

    14.8 You acknowledge and agree that, for the purposes of the Facility, the mobile app will be accessing the biometrics/face id registered in your permitted mobile device, and you hereby consent to the Bank accessing and using such information for the provision of the Facility.

    14.9 You understand the need to protect your permitted mobile device and shall be responsible for all use of your permitted mobile device (whether authorised by you or otherwise) to access the Facility.

    14.10 You understand that the biometrics/face id authentication module of the permitted mobile device is not provided by the Bank, and we make no representation or warranty as to the security of the Biometrics authentication function of any permitted mobile device and whether it works in the way that the manufacturer of the device represents.

    14.11 We do not represent or warrant that the Facility will be accessible at all times, or function with any electronic equipment, software, infrastructure, or other electronic banking services that we may offer from time to time. You are advised to disable the biometrics of any other person on the device and proceed.

  15. Virtual Credit Card

    Virtual Card will be issued only to a Primary Cardmember with a transaction limit which is lower to the limit available on the Card. Cardmember can make only domestic transactions using a virtual credit card till the time he/she receives the physical card. DBS Bank also provide an ability for Customers to view the card number, expiry date and CVV/CVC2 . However, the Virtual Card can be used to make purchases only through online merchant websites.

  16. Privacy Policy

    All Customer data and information provided to DBS Bank is subject to DBS Bank’s privacy policy. For DBS Bank’s updated privacy policy visit https://www.dbs.com/digibank/in/privacy-policy.page, which may be updated from time to time and the updated version of privacy policy shall automatically become applicable.

  17. Cache and Cookies Policy

    Our Digital Platforms use cookies. A cookie is a small text file placed on your computer or mobile device when you visit a website or use an app. Cookies collect information about users and their visit to the website or use of the app, such as their Internet protocol (IP) address, how they arrived at the website (for example, through a search engine or a link from another website) and how they navigate within the website or app. We use cookies and other technologies to facilitate your internet sessions and use of our apps, offer you products and/or services according to your preferred settings, track use of our websites and apps, to compile statistics about activities carried out on our websites and/or through our apps and to improve user experience and to provide and improve our services.

    You may also remove cookies stored from your computer or mobile device. However, do note that when you enable blocking of cookies, it may limit certain features and functions in your use of our websites or applications.
