These Terms of Service ("Terms") govern your use of statement verification services ("SVS") offered to you by DBS Bank India Limited ("DBS") through its vendor Perfios Software Solutions Private Limited ("Perfios").
"You/Your" means the customer who is accepting these Terms on internet and includes the ultimate beneficiary of the SVS.
"Website" means DBS Bank website or Perfios website as the case may be.
"Application" means DBS Bank’s mobile application.
"Statement Verification Services or SVS" means Perfios offered services on DBS Website/Application to access and analyze Your Bank information to help DBS review Your application for certain products/services availed/to be availed by You.
"Perfios" mean Perfios Software Solutions Private Limited, a service provider having its registered office currently at #1, Anagraha, 100 feet road 5th Block, Koramangala, Bangalore – 560095, India, providing the services of bank statement verification.
- By clicking on ‘Continue’ button You agree and accept to avail the SVS offered by DBS through Perfios having read, understood and accepted these Terms.
- By accepting the Terms, You understand that Perfios will get access to your bank’s transaction statement and the password/Security Code you may share (if required) for opening your bank transaction statement.
- Purpose of sharing Your information – You agree that You are providing Your Bank statement with DBS to enable DBS to decision Your application for DBS’ products/services and that the said information may be stored on DBS’ or DBS’ service providers’ computer systems. You agree that DBS is availing services of Perfios and pursuant to this arrangement, Perfios will get access to Your bank’s transaction statement. You understand and agree that Perfios will collect, access and analyze Your bank’s transaction statement on behalf of DBS. Perfios operates from its office currently having address at #1, Anagraha, 100 feet road 5th Block, Koramangala, Bangalore 560095, India. You agree and accept that Perfios may store the information You provide on cloud based servers.
- You agree that You are availing SVS voluntarily and for Your convenience.
- You are strictly prohibited from unauthorized use of DBS/Perfios systems or this Website/Application, including but not limited to unauthorized entry into the DBS/Perfios systems , or misuse of any information posted to this Website/Application.
- You acknowledge that DBS and Perfios are legally bound to disclose any information due to compulsions under law. You consent to the transmission, transfer or processing of such information to, or through, any country in the world, as we deem necessary or appropriate. You agree to such transfers. You expressly agree and acknowledge that usage of SVS may be monitored, tracked and recorded. As such You expressly consent to such monitoring, tracking and recording.
- You hereby expressly grant DBS and Perfios the license and right to utilize the information, data, password/Security Code contents, suggestions, ideas, feedback, etc., which You provide or give access to, for and on Your behalf to provide SVS. DBS will use such information with the sole purpose for providing You the required services and not for any other purpose. You hereby warrant and represent that You are duly authorized to submit or represent the third party (if any) on behalf of whom You are providing this information to the DBS and Perfios.
- DBS and Perfios shall in no event be responsible or liable to You or to any third party, whether in contract, warranty, tort (including negligence) or otherwise, for any indirect, special, incidental, consequential, exemplary, liquidated or punitive damages, including but not limited to loss of profit, revenue or business, business interruption, loss of information, or loss of savings, or any other damages arising – in any way, shape or form – out of the availability, use, reliance on, or inability to utilize the SVS arising in whole or in part from Your access to this Website/Application, Your use of SVS, even if DBS and/or Perfios has been advised of the possibility of such damages.
- You hereby indemnify and agree to defend, indemnify and hold harmless and keep the DBS and Perfios and their officers, directors, shareholders, and employees defended, indemnified and harmless at all times, from and against all loss, cost, damages, claims, expenses, suits, proceedings etc. that the DBS and/or Perfios may have to face or incur including but not limited to attorney’s fees, in whole or in part arising out of or attributable to any breach of these Terms by You, any misrepresentation or misuse of SVS availed by You or any negligent or unreasonable or inappropriate use of the Website/Application or SVS.
- You understand and acknowledge the risks involved in availing the SVS.
- These Terms shall be governed by the laws of India and You submit to the exclusive jurisdiction of courts in Mumbai.
