Terms & Conditions
1. Eligibility
1.1 The DBS/POSB 2010 Formula One Singtel Singapore Grand Prix Lucky Draw ("Draw") is conducted by DBS Bank Ltd ("DBS") and is open to all (except those persons listed under paragraph 1.2) eligible DBS and POSB account holders ("Account Holders") whose accounts are valid, subsisting and in good standing as may be determined by DBS at its sole and absolute discretion.
1.2 All employees of DBS and all DBS/POSB corporate customers are not entitled to participate and are disqualified from the Draw.
2. Qualifying Periods and Draw Dates
2.1 To qualifying for the Draw, entrants would need to be an Account Holder of an individual account as of 9 August 2010, midnight (“Qualifying Period”).
2.2 One (1) draw chance will be allocated to each eligible entrant during the Qualifying Period.
2.3 The draw date is on 18 August 2010 (“Draw Date”).
2.4 Unless DBS notifies otherwise, the Draws will be conducted in the presence of external auditors on the above date (or on such other dates as DBS may determine at its sole and absolute discretion) at 6 Shenton Way, DBS Tower 1 #02-01, Singapore 068809 or at such other venue as may be determined by DBS.
3. The Prize
3.1 There will be a total of three thousand (3000) pairs of 2010 Formula One Singtel Singapore Grand Prix (“Grand Prix”) Pit Grand Stand tickets (“Tickets”) to be won as follows:
(a) one thousand (1000) pairs of Tickets for the race on Friday 24 September 2010;
(b) one thousand (1000) pairs of Tickets for the race on Saturday 25 September 2010; and
(c) one thousand (1000) pairs of Tickets for the race on Sunday 26 September 2010
3.2 On the Draw Date, winners will be randomly drawn from the pool of eligible entries by means of a computerized draw under the supervision of an external auditor (“Winners”). DBS shall have the right to draw five hundred (500) “reserve winners” to replace any disqualified Winners.
3.3 DBS reserves the right to disqualify any Winner in its sole discretion and without notice, and to award his/her pair of Tickets to a reserve winner.
3.4 Each Account Holder is only eligible to win one pair of Tickets in the Draw.
3.5 The Winners will be published on DBS' website, in The Straits Times, Lianhe Zaobao, or where this is not practicable, in a local English-language newspaper, within ten (10) working days from the Draw Date. The Winners will also be notified by ordinary post within seven (7) working days from the Draw Date.
3.6 Tickets are strictly not for resale and cannot be exchanged for cash. Winners and all persons attending the Grand Prix accept the Tickets ‘as is’ and acknowledge that DBS accepts no responsibility for any variation in the value of the Tickets.
4. General
4.1 DBS is not an agent of any merchant. Any dispute about the quality, merchantability and fitness for purpose of the merchant’s goods and services must be resolved directly with the merchant.
4.2 All Winners and all persons attending the Grand Prix agree to be bound by the 2010 Formula One Singtel Singapore Grand Prix Conditions of Sale and Entry.
4.3 The Winner and all persons attending the Grand Prix agree to hold DBS harmless from and against any claim, action, proceeding, judgment, damage, loss, expense or liability suffered or incurred in connection with the Tickets and/or the Draw (including any error in computing any Draw entry, any breakdown or malfunction in any computer system or equipment) and/or any notice which is misdirected or lost in the post.
4.4 The Winner consents to DBS disclosing and/or publishing his/her name and any other of his/her particulars in any manner which DBS may deem fit for publicity purposes, and in the case where the Winner is a minor, to his/her parent(s) or legal guardian(s). The Winner shall cooperate with and participate in such publicity activity organised by DBS for these purposes. The failure by the Winner to comply with this clause shall result in his/her disqualification.
4.5 DBS’ decision on all matters relating to the Draw (including but not limited to the appropriate number of entries to be awarded to any eligible entrant, and the selection of the Winners) shall be final and binding. Except for the notification of the Winners (after any verification as may be required has been completed), DBS shall not be obliged to enter into any correspondence on any matter with any party concerning the Draw.
4.6 DBS may vary these terms and conditions without notice, or withdraw or discontinue the Draw at any time without any notice or liability to any party.
4.7 In the event of any inconsistency between these terms and conditions and any brochures, marketing or promotional materials relating to the Draw, these terms and conditions shall prevail.
4.8 These Terms and Conditions are governed under Singapore law and the parties agree to submit to the exclusive jurisdiction of the Singapore courts.
4.9 A person who is not a party to the terms herein shall have no right under the Contracts (Right of Third Parties) Act (Cap 53B) to enforce any of the terms of the Draw and notwithstanding any terms herein, the consent of any third party is not required for any variation (including any release or compromise of any liability) or termination of these
